In roundtable discussions, the Task Force often heard that there were certain groups for which education and other “population-level” measures were insufficient to reduce harms significantly. Most frequently, participants highlighted youth with a history of early and frequent use, or dependence. Other groups mentioned included adult heavy users, those with mental illness, people who are homeless and other marginalized groups. We can expect that the evidence with respect to THC potency, including the effects of CBD to reduce the effects of THC, will continue to evolve.
If the regime (e.g., production, distribution, taxation, consumer access, etc.) is too complex or onerous for enforcement and legal production and access, there will be opportunities for organized crime to satisfy the demand through the illicit market. Professor von Tigerstrom’s areas of teaching and research are medical law and ethics, public health law and policy, food and drug regulation, and tort law. THC limits were one of the most contentious and criticized issues around the amended regulations. Eatable and drinkable cannabis products will have a 10 mg THC per package limit, which is not very high. Ingestible extracts like tinctures, however, can have 1000 mg THC per package, with individual units capped at 10 mg. The reason for the delay, according to Health Canada, is a requirement mandating federal cannabis license holders to provide a 60-day notice to Health Canada of their intent to sell new products. Health Canada also says the lag is needed to give give regulators time to familiarize themselves with the new rules.
Maintaining independence and editorial freedom is essential to our mission of empowering investor success. We provide a platform for our authors to report on investments fairly, accurately, and from the investor’s point of view. We also respect individual opinions––they represent the unvarnished thinking of our people and exacting analysis of our research processes. These groups can be relied upon as important sources of knowledge and advice as governments move forward to enact the new system. Non-governmental organizations will play an important role in the implementation of the new system. We acknowledge the clear need for investment in detection and enforcement tools. Most importantly, investment in research to link THC levels to impairment and crash risk is required to support the establishment of a scientifically supported per se limit. In addition, investments to support the development of accurate and reliable roadside testing tools are required.

This policy allowed legal access to marijuana for Canadians who couldn’t find relief through regular medication. Given cannabis legalization is relatively recent and restricted to a few countries, the literature regarding this topic is limited and the number of studies exploring each attribute is scarce, especially in a post-legalization context. Although price was the most common attributed examined, many of the studies that examined aspects of price did so using distinct methodologies and data sources that should not be considered together. In studies that captured data on purchase history through a survey, prices were often exaggerated or recalled incorrectly, whereas administrative data captured actual purchase behavior.

Mr. Souccar also led the development of the drug-impaired driving legislation and the creation of the Drug Recognition Expert training for police officers. Funding will be required early to ensure a public education campaign is implemented ahead of legalization.
We acknowledge the challenges of smaller and remote communities that may not have the flexibility to accommodate dedicated, separate retail locations. Should separate retail locations not be feasible everywhere, safeguards to mitigate potential harms should be put in place to discourage co-use and mitigate the other concerns that have been raised. These should include training staff and using clear signage to educate and inform customers of the risks of co-use, banning cross promotion and stocking alcohol/tobacco and cannabis in physically separated spaces. This was believed to be more likely in a retail environment that favoured single-purpose or dedicated cannabis sales. Vendor training was seen as a way to provide some consistency of the information provided to consumers.

It can still be of really excellent quality, and you can always rely on a varied selection of AAA grade to be available almost all of the time from any respectable location. We will try our best to explain each level in some detail so that the next time you are choosing from a range of strains, you will have a better idea of their quality level. One more thing to point out before we get into the levels is, each cannabis strain could come in a number of different levels depending only on how that particular batch was grown. Therefore, the grading system is not a reflection on the strain itself, merely the grower and quality of that particular batch.

Tax and price policies should therefore focus on achieving the Government’s public health and safety objectives. Taxes should be high enough to limit the growth of consumption, but low enough to compete effectively with the illicit market. Mechanisms such as a minimum price should be used to prevent predatory pricing, if necessary. The argument that banned products would continue to be available on the illicit market was one we heard several times. However, in this case, we were told that the stakes were considerably higher due to the significant risks of illicit production of high-potency concentrates. Illicit producers often use highly flammable solvents such as butane to extract cannabinoids from plants, an inherently dangerous process that can also leave carcinogenic residues on the end product.
Jasmin Reggler was proud of her new job as legislative aide to a Rochester City Council member, but she was fired after just one month when her drug test came back positive for marijuana. Jasmin was not willing to accept the loss of her job for using marijuana on her own time, and she knew that many others had been unfairly denied employment or deterred from even applying for the same reason. In this time, tobacco has moved from being heavily marketed to being highly restricted, whereas alcohol has moved from being strictly controlled to being widely available and promoted. The Task Force further recommends that all governments across Canada consider the use of graduated sanctions ranging from administrative sanctions to criminal prosecution depending on the severity of the infraction. We believe that the new legal regime must be clear to the public and to law enforcement agencies, with enforceable rules and corresponding penalties that are proportional to the contravention. Survey data also tell us the frequency with which Americans are using marijuana. In 2011,16.7 percent of Americans 12 or older who had used the drug in the past year did so on 300 or more days within the past 12 months.
That’s likely because products like vapes and edibles may have lower barriers of entry for producers while the capital requirements to set up a flower cultivation facility may be too onerous for some. During calendar year 2010, nearly 10 million plantswere removed from nearly 24,000 illegal outdoor grow sites nationwide. These numbers provide insight into the size and scale of the negative environmental impact that marijuana cultivation can have on our Nation’s public lands. Outdoor marijuana grow site workers can also create serious wildfire hazards by clearing land for planting and by using campfires for cooking, heat, and sterilizing water. In August 2009, growers destroyed more than 89,000 acres in the Los Padres National Forest in Southern California.
The movement sprang out of Atlanta in 1976, as a number of support groups were formed for parents concerned about teen drug use. The groups soon spread across the country and began turning attention to legislative affairs such as halting decriminalization efforts and passing anti-paraphernalia laws. Momentum continued to grow as President Reagan took office in 1981 and first lady Nancy Reagan strongly embraced the cause.
Our focus ranged from global treaty obligations to the homes and municipalities in which we live. We heard anxiety about such things as driving, youth access and “sending the wrong message,” but we also heard a desire to move away from a culture of fear around cannabis and to acknowledge the existence of more positive medical and social attributes. Meanwhile, as we went about our mandate, dispensaries continued to challenge communities and law enforcement, new research findings emerged, new regulations appeared, and the media shone their light on issues of quality and regulatory gaps. More than half of the 50 United States have voted in favor of medical marijuana legalization, and nearly a fifth of all states have legalized the drug for recreational use. Since marijuana policy reform in America seems to be heading one way, it is vital that lawmakers heed the wisdom of researchers when it comes to drafting such policies. It is ever important that quality standards and age restrictions pay mind to experts in the field.
Under the newly elected Coalition Avenir Québec government, the Deputy Minister for Health in October 2018, Lionel Carmant announced that the Government will tighten the rules on cannabis consumption, including increasing the legal age to consume to 21 from 18. In 2019, CAQ announced Quebec will also ban the sale of cannabis candies and desserts, including chocolate, because federal cannabis regulations don’t go far enough in protecting children from accidentally consuming the drug. Most provinces have set the minimum age to purchase and consume cannabis to 19 years old, although Alberta has set it to 18 years old in line with their alcohol and tobacco laws and Quebec has set it to 21 years old. Manitoba and Quebec are currently the only provinces or territories where the legal cannabis age is not identical to the alcohol and tobacco purchase age (19 for cannabis in Manitoba and 21 in Quebec vs. 18 for alcohol/tobacco in both provinces).
The Customs and Border Protection policy creates a dangerous trap for people who don’t see a problem with admitting to legal cannabis use and are then surprised to find their pass taken away for life, says immigration lawyer Len Saunders. Regulatory sanctions should be proportionate to the contravention and include a range of enforcement options. For example, monetary penalties could be used to encourage licensed businesses to comply with the rules around packaging requirements for edible products, labelling on products and mandatory testing of products. Repeat violations or product safety concerns could be treated more severely (i.e., licence revocation or mandatory product recalls).
Federal lobbying records show that public servants, political staff members and cabinet ministers have received 583 visits or phone calls from marijuana industry lobbyists since Mr. Trudeau was sworn in as prime minister in November 2015. Private retailers are incentivized to respond to consumers’ preferences, ensuring that retail outlets are stocked with cannabis that meets desires of consumers in terms of price, quality, and variety. While a legal market populated by a large number of private retailers will offer the greatest competition to the illicit market, high-outlet density is positively correlated with earlier onset and levels of cannabis use.
The act also provided a model for state governments to follow, and by 1973 only two states still classified simple possession of cannabis as a felony. The public consultations on the design of a new legislative and regulatory system for restricted access to cannabis elicited feedback from nearly 1,500 individuals and organizations as well as 28,800 online responses. The responses and recommendations from Canadians, experts and organizations representing public health, governments, health-care professionals, patient organizations, industry and others were wide-ranging and informative.
